Hoop Loop Terms of Service

These terms are the agreement between you and the developer of Hoop Loop, a basketball throwing game for iOS and Android (bundle id org.fubl.throwit). By installing or playing the game you accept them. If you do not accept them, do not play.

The developer is Felix Ubl, in Vienna, Austria. Contact: hi@fubl.org. The full postal address is in section 14.

How the game handles data is a separate document, the Privacy Policy, and it forms part of these terms.

The short version

Play the game, keep your streak, buy gems if you want to. Do not cheat, do not automate it, do not try to break the leaderboard for other people. Coins and gems are part of the game, not money, and they cannot be cashed out. Purchases go through Apple or Google, so refunds go through them too. Nothing here takes away rights EU consumer law gives you.

1. Who may play

You may play if you are 13 or older. If you are under the age of digital consent in your country (13 to 16 depending on where you live), you need a parent or guardian's permission. The game is rated for teens and is not built for children.

If you are using a device that belongs to somebody else, make sure you are allowed to make purchases on it before you do.

2. Your licence to the game

You get a personal, non-exclusive, non-transferable, revocable licence to install and play Hoop Loop on devices you own or control, for your own private, non-commercial use.

You may not:

Everything in the game — the code, the artwork, the sounds, the name, the wordmark and the rim mark — stays the developer's property. These terms do not give you any of it.

3. Your account

The game has no sign-up. It creates an anonymous account for you the first time it reaches the server. You never give it an email address, a password or a name. Your handle is generated by the game, and your friend code is generated with it.

Because there is no email address on the account, there is no password reset. What there is instead is a recovery code, which you can create in the app and use to move your account to a new device. If you lose that code and lose the device, the account is gone and nobody can get it back for you. That is a consequence of the design, not an oversight, and it is the price of not asking you for an identity.

One account per person. Do not create accounts to farm referral rewards, to fill your own friends list, or to place several times on a leaderboard.

You can delete your account from inside the app. Deletion is described in the Privacy Policy.

4. Coins, gems and everything you unlock

Coins and gems are virtual items inside a game. They are not money, not currency, not a deposit, and not property. Specifically:

The same is true of skins, courts, hoops, balls, league passes and any other unlock.

The game's economy can change. Prices, rewards, drop rates, league prizes and how much anything costs may be adjusted, and features may be added or withdrawn. This is normal for a live game and it is not a breach of these terms. What will not happen is a change that retroactively removes something you paid real money for.

5. Buying things

In-app purchases are sold and processed by Apple on iOS and by Google on Android. The developer never sees your payment details. Your purchase is also subject to the store's own terms.

If a purchase is charged and does not arrive, contact hi@fubl.org with the store receipt and it will be sorted out.

6. Fair play, leaderboards and leagues

The leaderboards and the weekly leagues are the point of the game for a lot of people, so they are protected.

You must not:

If a score looks fabricated it may be removed without notice, and repeated or automated cheating may cost you access to the leaderboards, or the account. There is no appeals process and no compensation for lost virtual items in that case.

Leagues have an entry cost paid in coins. Entering does not guarantee a prize. Where a league does not fill enough for prizes to make sense, the entry is returned instead — the rules for that are stated in the game.

Some opponents in a league are not people. Where a league would otherwise be nearly empty it is filled out two ways: with other players' real scores mirrored in from another group, and with automated players.

Be clear about what the automated ones mean, because it is not nothing. An automated player is ranked alongside you like anybody else. It can finish above you and push you down a place, it can take one of the promotion spots, and it counts towards the number of players that decides whether a thin league pays prizes or returns everyone's entry instead.

What an automated player cannot do is take money. It has no account, and every payout in the game is collected by the person it belongs to under their own identity, so there is nothing that could pay one.

A mirrored player is not in that category at all. It is a real person playing the same game in the same week, and it counts as one — including towards whether your league was full enough to pay prizes.

7. Ads

The game shows ads, including rewarded ads you choose to watch. Ads come from Google AdMob and the developer does not control which specific ad you see. If an ad is offensive or broken, tell us and it can be reported upstream.

Watching a rewarded ad gives you what the game said it would. If an ad fails to load or finish, the reward may not be given — that is the ad network, not a decision by us.

8. Ending it

You can stop at any time by deleting the app, and you can delete the account from inside it.

The developer may suspend or close an account that breaks these terms, particularly section 6, and may withdraw the game or any part of it. Where the reason is not serious you will be given reasonable notice if it is practical to do so.

If your account ends for any reason, unused coins, gems and unlocks end with it. Statutory refund rights are not affected.

9. The game is provided as it is

Hoop Loop is made by one person. It is provided "as is" and "as available". There is no promise that it will be uninterrupted, error-free, or available in any particular country, and no promise that the leaderboard servers will always be reachable.

Nothing in this section limits your statutory rights as a consumer, including the statutory warranty for digital content under EU and Austrian law.

10. Liability

To the extent the law allows, the developer is not liable for indirect or consequential loss, lost data, lost virtual items, or loss caused by circumstances outside reasonable control.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for intent or gross negligence, or for anything else that cannot be excluded under Austrian law.

11. Changes to these terms

These terms may change — for example when a feature is added. When a change is material you will be told in the app before it takes effect. The date at the top says when this version was written. Carrying on playing after a change means you accept the new version; if you do not, stop playing and delete the account.

12. Law and disputes

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer in the EU, you keep the protection of the mandatory law of the country you live in, and you may bring a claim in your own country's courts.

The EU's online dispute resolution platform is at <https://ec.europa.eu/consumers/odr>. The developer is not obliged to take part in dispute resolution before a consumer arbitration board, and does not.

13. The rest

If any part of these terms turns out to be unenforceable, the rest still applies.

Not enforcing something once does not waive it.

These terms, together with the Privacy Policy, are the whole agreement between you and the developer about Hoop Loop.
